Agreement to Terms
By accessing and using the FRG Fargo Masonry website or services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. Services Provided
FRG Fargo Masonry provides professional masonry services including but not limited to brick repair, chimney services, tuckpointing, retaining walls, stone patios, and other masonry work. All services are subject to availability and scheduling. We reserve the right to refuse service to anyone for any reason at any time.
All estimates and quotes provided are valid for 30 days from the date issued unless otherwise specified. Final pricing may vary based on site conditions, material costs, or changes requested by the client. We will notify you of any significant price changes before proceeding with work.
Payment Terms
Payment terms will be specified in your project contract or agreement. Typically, a deposit may be required to begin work, with the balance due upon completion. We accept various payment methods including cash, check, and major credit cards. Late payments may be subject to additional fees as specified in your contract.
All prices are in US Dollars. You are responsible for paying all applicable taxes and fees associated with your project. If you dispute any charges, you must notify us within 10 days of receiving your invoice.
Project Timelines and Delays
We provide estimated timelines for project completion, but these are subject to change due to weather conditions, material availability, site conditions, or other factors beyond our control. We will make reasonable efforts to notify you of any significant delays and work to complete your project as quickly as possible while maintaining our quality standards.
You agree to provide reasonable access to your property during scheduled work times. Delays caused by lack of access, client-requested changes, or unforeseen site conditions may extend the project timeline and potentially affect pricing.
Warranties and Guarantees
We stand behind the quality of our workmanship. Specific warranty terms will be provided in your project contract. Warranties typically cover defects in workmanship for a specified period but do not cover damage caused by normal wear and tear, improper maintenance, acts of nature, or modifications made by others.
Material warranties are provided by the manufacturer and are subject to their terms and conditions. We will assist you with warranty claims when applicable, but we are not responsible for manufacturer defects or failures.
Limitation of Liability
To the fullest extent permitted by law, FRG Fargo Masonry shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services or any errors or omissions in our work. Our total liability for any claim arising out of or relating to our services shall not exceed the amount you paid for the specific service giving rise to the claim.
We maintain appropriate insurance coverage for our business operations. All work is performed by licensed and insured professionals. In the event of damage to your property caused by our negligence, our liability is limited to the coverage provided by our insurance policies.
Property Access and Site Conditions
By engaging our services, you grant us access to your property to perform the agreed-upon work. You are responsible for ensuring that pets are secured and that the work area is reasonably accessible. You must disclose any known hazards or site conditions that could affect our work or the safety of our crew.
We will take reasonable precautions to protect your property during our work. However, we are not responsible for damage to underground utilities, sprinkler systems, or other hidden features that are not properly marked or disclosed to us before we begin work.
Permits and Approvals
Unless otherwise specified in your contract, you are responsible for obtaining any necessary permits, approvals, or permissions required for your project. We can assist with permit applications and work with local authorities on your behalf, but any delays or denials resulting from the permit process are not our responsibility.
All work will be performed in accordance with applicable local building codes and regulations. If code requirements change after we provide an estimate, additional costs may apply to ensure compliance.
Cancellation and Refunds
If you need to cancel or reschedule your project, please notify us as soon as possible. Cancellation terms and any applicable fees will be specified in your contract. Deposits may be non-refundable if work has already been scheduled or materials have been ordered.
We reserve the right to cancel or refuse service if we determine that site conditions, weather, or other factors make it unsafe or impractical to complete the work. In such cases, we will work with you to reschedule or provide a refund for any payments received.
Intellectual Property
All content on the FRG Fargo Masonry website, including text, images, logos, and designs, is the property of FRG Fargo Masonry and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute our content without our express written permission.
We may photograph completed projects for use in our marketing materials, website, and social media. If you prefer that your project not be photographed or shared, please let us know in writing before work begins.
Governing Law and Disputes
These Terms of Service shall be governed by and construed in accordance with the laws of the State of North Dakota, without regard to its conflict of law provisions. Any disputes arising from these terms or our services shall be resolved in the courts located in Cass County, North Dakota.
Before pursuing legal action, we encourage you to contact us directly to resolve any issues or concerns. Most disputes can be resolved through open communication and good faith negotiation.
